HOW LONG CAN I RENT THE SAME PROPERTY?

There a few answers to this question.

When renting a residential property in London, most tenants will sign an AST (Assured Shorthold Tenancy agreement). This is the legal document in England and Wales which sets out the Terms and Conditions of renting a property between the Landlord and the Tenant.

An AST can state that the fixed rental period is for a minimum of 6 or 12 months up to a maximum of 3 years. This does not mean you need to leave the property after 3 years; if both the landlord and the tenant agree, the AST can be extended. A separate addendum document will need to be signed by both parties.

Alternatively, if no addendum is signed after the expiry of the fixed term of renting and the tenant continues to rent the property, the agreement becomes a periodic tenancy which runs from month-to-month. In such a case, either the landlord or the tenant can serve notice on each other giving a minimum of 2 months’ notice if the rent is paid monthly in advance.

NB: If your annual rent is more than £100,000, an AST can not be used. Instead, you will sign a non-Assured Tenancy Agreement (also known as a Common Law contract).
